Contest Terms and Conditions

NO PURCHASE NECESSARY. PURCHASE WILL NOT IMPROVE CHANCES OF WINNING.

1. ELIGIBILITY: The “FullSpeed.com Contest” (“Contest”) is open to legal U.S. residents only, ages 13 and older at the time of entry. Employees of FullSpeed.com (“Sponsor”), affiliates, subsidiaries, advertising and production agencies, electronic media firm, and members of their immediate families or households are not eligible to participate. Void where prohibited by law. Federal, state and local laws and regulations apply.

2. HOW TO ENTER: Entrants may begin creating FullSpeed profiles on October 14th at 12:01 AM Pacific Time (“PT”). All profiles entitled to win must be entered by December 31, 2009 at 11:59PM PT. Online entrants must be the authorized account holder (or the parent or legal guardian of a minor entrant) of the email account from and for which the entry is made. By entering this Contest, entrants and the parent or legal guardian of entrants accept and agree to be bound by these Official Rules.

3. PRIZES AND APPROXIMATE RETAIL VALUE (“ARV”): New 4GB Apple iPod Shuffle ($79 ARV) will be awarded via an arbitrary drawing every month. Expenses not mentioned above are the winner’s responsibility. Odds of winning depend on the number of eligible profiles created each month.

4. WINNER SELECTION AND NOTIFICATION: Winners will be announced on or about October 31st, November 30th, and December 31st, 2009. Limit of one prize per person. Winners will be notified by e-mail and may be required to complete an Affidavit of Eligibility and Liability/Publicity Release (“Affidavit”), which must be returned within 14 days of the date on the notification or an alternate winner will be selected. If the Winner is under the age of 18, the Winner’s parent or legal guardian will be required to execute the Affidavit on behalf of the winner. Any prize notification or prize returned as undeliverable will be awarded to an alternate winner. No substitution for prize, unless at Sponsor’s sole discretion. Prize is not transferable or redeemable for cash. Sponsor and its agents are not responsible for any liability associated with the acceptance or use of or inability to use a prize. Winners and the parent or legal guardian of winners acknowledge that prizes are awarded “as is” and that any representation, guarantee or warranty, express or implied, in law or in fact, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose is expressly disclaimed.

5. TAXES. All federal, state and/or local income and other taxes, if any, are the winner's sole responsibility.

6. RELEASE OF LIABILITY: By entering, the entrants and the parent or legal guardian of entrants agree to hold harmless the Sponsor, its subsidiaries, affiliates, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents, from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of a prize in the Contest, or their participation in the Contest, or their participation in any Contest or prize related activity.

7. GENERAL TERMS: Sponsor and its agents are not responsible for lost, late, misdirected, damaged, incomplete or illegible entries or Internet technical, hardware, software, telephone, or transmission failures of any kind, which may limit a person’s ability to enter the Contest. Sponsor and its agents are not responsible for any injury or damage to entrants’ or any other person’s computer related to or resulting from entering or downloading any materials in the Contest. Sponsor reserves the right to cancel or suspend advertising the Contest on the Internet should a computer virus, unauthorized intervention or other cause corrupt the integrity or proper conduct of the promotion. Sponsor reserves the right to disqualify any entrant found to be disrupting the operation of the Contest or its web site. No transfer or assignment of entries is permitted. Entrants retain all rights to video submissions but agree to grant non-exclusive, non-commercial rights for usage to the Sponsor.
